北京市住房和城鄉(xiāng)建設(shè)委員會(huì)關(guān)于做好工程建設(shè)項(xiàng)目審批制度改革試點(diǎn)工作的通知

各區(qū)住房城鄉(xiāng)建設(shè)委、東城、西城區(qū)住房城市建設(shè)委、經(jīng)濟(jì)技術(shù)開發(fā)區(qū)建設(shè)局：

為切實(shí)落實(shí)好《國(guó)務(wù)院辦公廳關(guān)于開展工程建設(shè)項(xiàng)目審批制度改革試點(diǎn)的通知》（國(guó)辦發(fā)〔2018〕33號(hào)）、《北京市工程建設(shè)項(xiàng)目審批制度改革試點(diǎn)實(shí)施方案》（京政辦發(fā)〔2018〕36號(hào)）等文件精神，進(jìn)一步做好建設(shè)項(xiàng)目審批制度改革試點(diǎn)工作，提升“放管服”水平，現(xiàn)將有關(guān)工作要求通知如下：

一、各建設(shè)行政主管部門對(duì)建設(shè)項(xiàng)目新申辦建筑工程施工許可證的，要嚴(yán)格執(zhí)行《國(guó)務(wù)院辦公廳關(guān)于開展工程建設(shè)項(xiàng)目審批制度改革試點(diǎn)的通知》（國(guó)辦發(fā)〔2018〕33號(hào)）、《北京市工程建設(shè)項(xiàng)目審批制度改革試點(diǎn)實(shí)施方案》（京政辦發(fā)〔2018〕36號(hào)）要求，精簡(jiǎn)審批前置要件。

二、建設(shè)項(xiàng)目新申辦建筑工程施工許可證的，取消“建設(shè)單位項(xiàng)目資金落實(shí)證明文件”，由建設(shè)單位出具《建設(shè)項(xiàng)目法人承諾書》，承諾項(xiàng)目建設(shè)資金已經(jīng)落實(shí)。

三、取消建設(shè)項(xiàng)目施工合同備案。

四、將工程質(zhì)量監(jiān)督注冊(cè)、工程施工安全監(jiān)督備案和建設(shè)工程施工許可證核發(fā)合并辦理。建設(shè)單位除提交施工許可申報(bào)材料外，無(wú)需再提交其他材料。施工許可證核發(fā)后，信息系統(tǒng)平臺(tái)將相關(guān)信息推送給質(zhì)量和安全監(jiān)督管理部門。

五、建設(shè)單位需承諾施工圖設(shè)計(jì)文件符合國(guó)家標(biāo)準(zhǔn)規(guī)范，新建擴(kuò)建項(xiàng)目、現(xiàn)狀改建項(xiàng)目應(yīng)在底板施工前取得審查合格書；內(nèi)部改造項(xiàng)目、市政基礎(chǔ)設(shè)施項(xiàng)目應(yīng)在正式施工前取得施工圖審查合格書。

六、嚴(yán)格落實(shí)施工許可審批時(shí)限要求，對(duì)于符合法定要求的，自受理之日起5個(gè)工作日內(nèi)應(yīng)當(dāng)完成施工許可證審批工作。

七、各建設(shè)行政主管部門要結(jié)合試點(diǎn)工作推進(jìn)情況持續(xù)開展宣傳引導(dǎo)和政策解讀，做好改革措施的宣傳、培訓(xùn)和服務(wù)工作，通過(guò)多種形式及時(shí)宣傳試點(diǎn)工作的改革措施和取得的成效。

八、本通知自發(fā)布之日起實(shí)施。

Notice of the Beijing Municipal Commission of Housing and Urban-Rural Development on Effectively Implementing the Pilot Program of the Reform of the Approval System for Construction Projects

Commissions of Housing and Urban-Rural Development of various districts, Commissions of Housing and Urban Development of Dongcheng and Xicheng districts, and Construction and Development Bureau of Beijing Economic-Technological Development Are:

To effectively implement the spirits of the Notice of the General Office of the State Council on Launching the Pilot Program of the Reform of the Approval System for Construction Projects (Guo Ban Fa [2018] No. 33) and the Implementation Plan of Beijing Municipality for the Pilot Program of the Reform of the Approval System for Construction Projects (Jing Zheng Ban Fa [2018] No. 36), further optimize Pilot Program of the Reform of the Approval System for Construction Projects and improve the level in “the reform of delegating powers, improving regulation and optimizing services”, the Beijing Municipal Commission of Housing and Urban-Rural Development hereby notifies the related matters as follows:

1. When handling new application for construction permits for construction projects, all administrative departments competent for construction shall strictly comply with relevant requirements in the Notice of the General Office of the State Council on Launching the Pilot Program of the Reform of the Approval System for Construction Projects (Guo Ban Fa [2018] No. 33) and the Implementation Plan of Beijing Municipality for the Pilot Program of the Reform of the Approval System for Construction Projects (Jing Zheng Ban Fa [2018] No. 36) and streamline the preconditions for approval.

2. In the event of any new application for the new construction permit for the construction project, the “proof of funds availability by the construction unit” is cancelled where the construction unit is required to present the “Legal Person Commitment for Construction Projects” to promise that the funds for the construction project are well available.

3. Filing of the construction contract for the construction project is cancelled.

4. The applications for the Quality Supervision Registration, the Construction Safety Supervision Filing and the Construction Permit for Construction Project will be examined and issued concurrently. The construction unit is no longer required to submit any other materials other than the application materials for construction permission. Once the construction permit is approved and issued, the information system platform will push relevant information to administrative departments competent for quality and safety supervision.

5. The construction unit shall undertake that its construction drawing design documents comply with national standards and regulations and the Certificate of Compliance shall be obtained before the base plate construction of any new or expansion project or reconstruction project; the Certificate of Compliance of Construction Drawings shall be obtained before the formal construction of any internal renovation project or municipal infrastructure project.

6. The time limit for the approval of construction permission shall be strictly observed. For any legible project, the examination and approval of the construction permit shall be completed five working days from application acceptance.

7. All administrative departments competent for construction shall consistently carry out publicity, guidance and policy interpretation on the basis the pilot program progress and do a good job in propaganda, training and service of the reform measures by publicizing, through multiple channels, the reform measures and achievements of the pilot work.

8. This Notice will come into force as of the date of promulgation.
